This Privacy Policy explains how Hemest ("Hemest", "we", "us", or "our") collects, uses, stores, and shares personal information when you visit our website, contact us, request affiliate approval, submit a website or project questionnaire, use our internal sales-call console, or otherwise interact with our website and services (collectively, the "Service").

By using the Service, submitting information, communicating with us, or continuing to interact with Hemest after this Privacy Policy is posted, you acknowledge this Privacy Policy and, where permitted or required by applicable law, agree and consent to the collection, use, disclosure, retention, processing, and transfer of information in accordance with this Privacy Policy and any applicable agreement. If you do not agree with this Privacy Policy, you should not use the Service or submit information to Hemest.

This Privacy Policy is intended to reflect the website as it currently operates, while also describing certain tools Hemest may add or use in the future where noted. Hemest does not currently offer public user accounts, passwords, login profiles, or public posting areas on the website.

This Privacy Policy should be read together with any applicable quote, statement of work, client agreement, Terms of Service, Affiliate Program Terms, data processing agreement, or other written agreement with Hemest. If a more specific written agreement applies to a project, client relationship, affiliate relationship, or service, that agreement may contain additional privacy, confidentiality, security, ownership, support, liability, or data-handling terms. Nothing in this Privacy Policy limits Hemest's rights or remedies under those agreements, except where applicable privacy law requires otherwise.

This Privacy Policy is not a guarantee that any particular service, feature, third-party tool, security measure, retention period, or data practice will remain unchanged. We may modify, suspend, replace, or discontinue features, vendors, integrations, forms, workflows, and business processes from time to time, subject to applicable law and any written agreement that applies.

Key Privacy Practices

Hemest currently uses Google Forms and Google Sheets for website forms, including contact, affiliate request, website or project questionnaires, and internal sales-call console logs.
Hemest currently uses necessary cookie-control cookies to remember consent choices and optional affiliate attribution cookies only if you accept that category.
Hemest does not currently use Google Analytics, advertising cookies, remarketing cookies, account login cookies, live chat, or a dedicated support-ticketing system.
Hemest may add analytics, web beacons, pixels, support tools, chat tools, Google Places, mapping tools, advertising tools, measurement tools, or similar services in the future, subject to this Privacy Policy and applicable law.
Hemest does not currently provide public user accounts, public posting areas, or public profiles on the Website.
You should not send confidential, regulated, highly sensitive, or third-party personal information unless you have authority to do so and Hemest has agreed to receive it through the relevant channel.

Interpretation and Definitions

Interpretation

Words with initial capital letters have meanings defined under the following conditions. These definitions have the same meaning whether they appear in singular or plural.

Definitions

For the purposes of this Privacy Policy:

Affiliate means a referral partner, related entity, or other party involved in an affiliate or referral relationship with Hemest.
Company (referred to as "Hemest", "the Company", "we", "us", or "our") means Hemest, 681 Sevilla Park Pl, London, Ontario, Canada.

Website means the Hemest website.
You means the individual accessing or using the Website or services, or the company or other legal entity on behalf of which that individual is acting.

Information We Collect

Information You Provide

We collect information that you choose to provide, including, but not limited to:

contact form details, such as your name, email address, phone number, business details, and message;
affiliate request details, such as your name, contact details, organization, website or social profile, market, country, referral approach, expected lead volume, payout preference, and agreement to the affiliate terms;
website, sales, or project questionnaire details, such as business information, services, service areas, goals, timelines, links, preferences, and notes you submit;
internal sales-call console details, such as prospect business name, contact name, role, website, phone number, email address, industry, sales notes, call path, call outcome, objections, and completed follow-up steps;
support or communication details if support, chat, help desk, CRM, scheduling, email routing, call recording, transcription, or similar tools are used in the future, including support tickets, chat transcripts, email metadata, attachments, call notes, call recordings, transcripts, agent notes, and follow-up records; and
any other information you send to us by email, forms, documents, calls, or messages.

Do not submit confidential, regulated, or highly sensitive information through ordinary website forms or email unless we have specifically asked for it and agreed on an appropriate handling process.

Unless Hemest expressly agrees in writing, Hemest does not agree to receive or process regulated health information, payment card data, government identification numbers, financial account numbers, children's information, special-category information, trade secrets, privileged information, or information subject to industry-specific security requirements through ordinary website forms, Google Forms, Google Sheets, or email. If you submit that information anyway, you do so at your own risk and Hemest may delete, ignore, return, de-identify, or retain it only as needed to protect rights, comply with law, document the submission, or manage risk.

Submitting information through the Website, forms, email, or the internal sales-call console does not by itself create a client relationship, fiduciary relationship, professional adviser relationship, agency relationship, partnership, confidential relationship, or duty to preserve information beyond what is required by applicable law or a written agreement signed or accepted by Hemest.

If you submit information about another person, business, client, prospect, employee, contractor, lead, affiliate, or other third party, you represent that you have the authority, permission, and legal basis required to provide that information to Hemest and to allow Hemest to use it for the purposes described in this Privacy Policy and any related agreement. You are responsible for the accuracy, legality, and completeness of information you submit.

We may reject, delete, de-identify, archive, or decline to act on information that appears incomplete, inaccurate, fraudulent, unlawful, excessive, irrelevant, sensitive, confidential, or outside the scope of the Website, services, affiliate program, or applicable agreement.

Information from Third Parties and Public Sources

Hemest may collect information about businesses, prospects, clients, affiliates, referral partners, and related contacts from third parties and public sources, including, but not limited to, referral partners, affiliates, clients, business websites, public social media profiles, search results, online directories, public business listings, Google Business Profile listings, trade shows, conferences, events, public databases, government registries, advertising platforms, lead sources, or contact-data providers if used.

This information may include, but is not limited to, business name, contact name, role, title, business email address, business phone number, business address, website, social profile, service area, industry, public reviews, public business details, referral context, lead source, outreach history, and notes about potential fit for Hemest services.

We may use this information to identify prospects, evaluate potential fit, conduct outreach where permitted by law, verify referrals, administer the affiliate program, prevent duplicate leads, document sales workflows, prepare quotes, provide services, and maintain business records.

Technical and Usage Data

We may collect limited technical information automatically when you use the Website, including, but not limited to:

IP address, browser type, browser version, operating system, Device information, pages visited, access times, referring pages, request URLs, form events, error data, diagnostic logs, hosting logs, CDN logs, security logs, and server logs collected through hosting and website infrastructure;
affiliate attribution details when you arrive with an approved referral parameter; and
local browser storage used by the internal sales-call console to save draft console state on the device using it.

Certain business contact information, such as a person's name, title, business address, business email address, or business telephone number, may be excluded from or treated differently under some privacy laws when used only to contact that person in their business capacity. Where such information is subject to applicable privacy law or is combined with other information, we handle it as described in this Privacy Policy.

Google Forms and Google Sheets

Hemest uses Google Forms and Google Sheets to receive, route, and store website form submissions. This includes the contact form, affiliate request form, website or project questionnaires, and internal sales-call console logs.

When you submit one of these forms, the information you enter is sent to Google and may be stored in Google Forms and/or Google Sheets. Google processes that information under its own privacy and security terms. You can review Google's Privacy Policy at https://policies.google.com/privacy.

Hemest does not control Google's systems, security practices, service availability, subcontractors, data-center locations, product changes, or legal obligations. To the fullest extent permitted by law, Hemest is not responsible for outages, changes, data handling, access controls, retention, deletion timing, or other acts or omissions of Google or any other third-party Service Provider, except to the extent Hemest is legally responsible for its own selection, configuration, instructions, or use of that provider.

Hemest may use Tracking Technologies to operate, secure, measure, personalize, improve, market, and document the Service, including, but not limited to, Cookies, local storage, session storage, server logs, pixels, tags, scripts, Web Beacons, clear GIFs, embedded content, referral parameters, UTM parameters, SDKs, and similar technologies.

Web Beacons may be used in website pages, forms, emails, support messages, marketing messages, or other communications to help determine whether a page was viewed, whether an email was delivered or opened, whether a link was clicked, whether a form or script worked correctly, or whether a communication or system is being abused. Hemest does not currently use Web Beacons for advertising or remarketing, but may use them in the future where permitted by law.

Cookies may be "Session" Cookies or "Persistent" Cookies. Session Cookies are generally deleted when you close your browser. Persistent Cookies remain on your Device until they expire or are deleted. Cookies may also be first-party Cookies set by Hemest or third-party Cookies set by Service Providers.

Depending on the features, vendors, and tools used at a given time, Cookies and similar technologies may include:

Strictly Necessary or Essential Cookies: used to operate the Website, maintain security, process forms, remember legally required consent choices, prevent abuse, support load balancing, or provide requested functionality. These may be required for parts of the Service to work.
Affiliate Attribution Cookies: optional cookies used to record referral or affiliate information, including approved referral parameters, landing page, and capture time.
Preference or Functionality Cookies: used to remember choices such as display settings, language, region, form state, or other preferences if those features are added.

The current cookie-control tool may set the following necessary cookies for up to one year:

hemest_cookie_consent: records whether a cookie choice was made; and
hemest_cookie_categories: records which cookie categories were enabled.

Where required by law, optional analytics, advertising, marketing, remarketing, preference, support, chat, or similar non-essential cookies will be used only with consent or another lawful basis. Necessary cookies may be used without consent where they are required to provide a requested service, operate the Website, remember privacy choices, prevent abuse, or comply with law.

Affiliate Attribution Cookies

Hemest currently uses optional website cookies for affiliate attribution only after you accept the affiliate attribution cookie category.

If you visit the Website using an affiliate or referral parameter, such as sa, ref, aff, or affiliate, we may store the following cookies for up to 90 days:

hemest_affiliate: the affiliate or referral code;
hemest_affiliate_landing_page: the page where the referral was captured; and
hemest_affiliate_captured_at: the date and time the referral was captured.

These cookies help Hemest review whether a later form submission, inquiry, or client relationship may be connected to an approved affiliate referral. Final affiliate credit is still subject to manual review and the Affiliate Program Terms.

You can reject, block, or delete affiliate attribution cookies through the cookie-control tool or your browser settings. If you reject, block, or delete these affiliate attribution cookies, affiliate tracking may not work correctly.

Analytics, Advertising, and Similar Technologies

Hemest does not currently use website cookies for advertising, remarketing, Google Analytics, login sessions, or language preferences.

We may add analytics or measurement tools in the future, such as Plausible, Google Analytics, Matomo, Umami, Fathom, Simple Analytics, or similar services. If we use analytics tools, they may collect information including, but not limited to, page views, referral sources, browser and Device information, approximate location, events, session data, performance data, error data, or other Usage Data to help us understand and improve the Website and services.

Where required by law, we will use non-essential analytics, advertising, remarketing, or similar cookies only with consent or another lawful basis. If we add tools that materially change how we collect or use information, we will update this Privacy Policy and any required cookie or consent notices.

Google Places and Mapping Tools

Hemest does not currently use Google Places on this Website.

We may use Google Places, Google Maps, address autocomplete, location search, or similar mapping tools on this Website or in client projects in the future. If those tools are used, Google or another mapping provider may collect information from your Device, search query, address entry, IP address, or interaction with the tool for security, functionality, analytics, or service-improvement purposes. Google's Privacy Policy is available at https://policies.google.com/privacy.

For client websites or tools that Hemest builds or supports, the client's own privacy policy or notice may also apply.

Local Storage for Internal Console

The internal sales-call console uses browser local storage to save draft call-console state on the device using the console. This allows the console to restore in-progress call notes locally. Submitting a log sends the selected call details to Google Forms and/or Google Sheets as described above.

Support, Chat, CRM, and Communications Tools

Hemest does not currently use a dedicated support-ticketing system or live-chat platform on the Website. We may add support, chat, CRM, scheduling, email-routing, call-recording, transcription, help-desk, or similar communications tools in the future.

If those tools are used, they may collect and store information including, but not limited to, support tickets, chat transcripts, email content, email metadata, attachments, call notes, call recordings, transcripts, message timestamps, agent notes, follow-up records, Device and browser information, IP address, referral source, page context, and diagnostic logs. These tools may also use Cookies, Web Beacons, scripts, pixels, tags, local storage, or similar technologies to operate, secure, route, measure, or improve support and communications.

We may use support and communication records to respond to requests, provide services, train or supervise personnel, improve scripts and processes, verify instructions, document disputes, prevent abuse, maintain business records, enforce agreements, and protect legal rights.

How We Use Information

Hemest may use personal information for purposes including, but not limited to, the following:

respond to inquiries, quote requests, contact forms, and project questionnaires;
review affiliate applications and manage affiliate attribution;
prepare, deliver, support, document, and improve website services;
process project information and website questionnaires;
operate internal sales workflows, call notes, and follow-up records;
detect spam, fraud, abuse, duplicate leads, or technical issues;
maintain website security, troubleshoot errors, and protect our rights;
comply with legal, tax, accounting, contractual, and regulatory obligations;
enforce our Terms of Service, Affiliate Program Terms, and agreements;
verify authority, eligibility, identity, payment status, consent, attribution, or the accuracy of submissions where reasonably necessary;
investigate, prevent, respond to, or document suspected fraud, spam, abuse, misrepresentation, unauthorized access, security incidents, chargebacks, disputes, unlawful activity, or violations of our agreements;
collect amounts owed, manage refunds, administer billing records, and support accounting, insurance, audit, and professional-adviser processes;
evaluate or conduct a business sale, merger, financing, restructuring, reorganization, dissolution, or similar transaction; and
analyze, improve, and market our services, including measuring interest in services and communicating about related services where permitted by law.

We may use contact information to follow up about services you requested, purchased, discussed with us, or may reasonably expect to hear about from us. We may also send promotional or informational communications where permitted by law or with consent where consent is required. You can ask us to stop sending marketing communications.

Where required by Canada's Anti-Spam Legislation or other applicable marketing laws, commercial electronic messages will include required sender information and an unsubscribe mechanism. A request to stop marketing communications does not prevent us from sending non-marketing communications, including replies to your inquiries, project messages, transactional records, legal notices, security notices, service updates, or communications required to administer an agreement.

We do not sell your personal information for money. If a future analytics, advertising, remarketing, measurement, or similar tool is considered a "sale", "share", targeted advertising disclosure, or similar regulated disclosure under an applicable privacy law, we will update this Privacy Policy and provide any legally required notices or choices.

Legal Bases

Depending on the situation and applicable law, Hemest processes personal information because:

you consented, such as by submitting a form, accepting affiliate terms, or contacting us;
processing is necessary to respond to your request or perform a contract;
we have a legitimate business interest in operating, securing, improving, documenting, and marketing our services;
processing is necessary to comply with legal, tax, accounting, or regulatory obligations; or
processing is necessary to establish, exercise, or defend legal claims.

In some situations, applicable law may permit or require Hemest to collect, use, retain, or disclose personal information without consent, including for fraud prevention, security, debt collection, legal compliance, investigations, emergencies, business transactions, or protection of legal rights. If you withdraw consent, the withdrawal applies only to future processing based on consent and does not affect processing already completed or processing that Hemest may continue because of another lawful basis, legal obligation, contract, dispute, record-keeping requirement, security need, or legitimate business interest recognized by applicable law.

We may share personal information with:

Service Providers that help us operate the Website, host data, process forms, communicate with you, manage files, invoice clients, receive payments, analyze website performance, or provide professional services;
Google, because Google Forms and Google Sheets are used for form submissions and related storage, and because Google Places, Google Maps, or related tools may be used in the future;
analytics, measurement, advertising, cookie-control, consent-management, support, chat, CRM, call-recording, transcription, email-delivery, scheduling, or marketing Service Providers if we add those tools in the future and where permitted by law;
payment processors, accounting providers, legal advisors, insurers, or similar business support providers when needed;
affiliates, referral partners, business partners, or promotional partners where needed to validate or administer an affiliate referral, provide a requested service, offer related services, run a permitted promotion, or communicate with you where permitted by law or with consent where required;
public authorities, courts, regulators, law enforcement, or other parties where required by law or necessary to protect rights, safety, security, or legal interests; and
parties involved in a business sale, merger, financing, restructuring, reorganization, dissolution, acquisition, asset transfer, bankruptcy, liquidation, or similar transaction.

We do not provide public posting areas on the Website. Information you submit through forms is not intended to be publicly visible on the Website.

We may also disclose personal information to a client, prospect, affiliate, referral partner, or other person connected to the relevant submission, project, lead, dispute, payment, referral, or request where reasonably necessary to verify facts, administer the relationship, prevent fraud, resolve a dispute, or provide the requested service.

We may use or share aggregated, anonymized, or de-identified information for analytics, benchmarking, service improvement, business planning, marketing, research, or similar purposes, provided it is not reasonably capable of identifying you.

Client Projects and Third-Party Data

When Hemest builds, supports, audits, hosts, or integrates a website, form, sales process, automation, or other tool for a client, the client may control or be responsible for some of the personal information collected through that client's website, forms, accounts, documents, workflows, or business systems.

Unless a written agreement says otherwise, the client is responsible for determining what personal information is collected from its own customers, prospects, employees, contractors, affiliates, or users, for providing any required privacy notices, for obtaining any required consents, and for ensuring that its instructions to Hemest are lawful. Hemest may process that information to provide services to the client, comply with the client's documented instructions, protect Hemest's rights, comply with law, maintain business records, and perform related support, security, troubleshooting, billing, and administrative functions.

If you are a Hemest client and you provide personal information about another person to Hemest, you represent that you have all rights, permissions, notices, consents, and legal authority required to provide that information and to instruct Hemest to process it.

Retention

We keep personal information only as long as reasonably needed for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

Typical retention periods are:

contact inquiries and support correspondence: up to 24 months after the last meaningful interaction;
support tickets, help-desk records, chat transcripts, call notes, call recordings, transcripts, CRM records, scheduling records, and related communication records if those tools are used: up to 24 months after the last meaningful interaction, unless a longer period is needed for client records, disputes, legal claims, security, training, tax, accounting, or business administration;
affiliate applications, attribution records, payout records, and referral review notes: up to 7 years where needed for tax, accounting, fraud prevention, dispute, and program administration purposes;
client project records, questionnaires, contracts, invoices, and related communications: up to 7 years after the end of the client relationship, or longer if required for legal, tax, accounting, or dispute reasons;
internal sales-call console logs: up to 24 months unless the prospect becomes a client, asks us to keep information, or the information is needed for legal or business records;
affiliate attribution cookies: up to 90 days;
server logs, hosting logs, CDN logs, diagnostic logs, security records, and abuse-prevention records: up to 24 months, unless longer retention is needed for security, troubleshooting, abuse prevention, fraud prevention, dispute handling, or legal compliance;
cookie-control or consent records: up to one year, or as long as reasonably needed to document consent, withdrawal, or preference history; and
analytics, Web Beacon, advertising, marketing, support, or measurement data, if those tools are added in the future: for the period configured in the applicable tool, unless a shorter or longer period is required for legal, security, or operational reasons.

When information is no longer needed, we delete, anonymize, or archive it in accordance with our operational and legal requirements. Residual copies may remain in backups for a limited period and are not restored except where necessary for security, disaster recovery, or legal compliance.

We may retain personal information beyond the periods above where necessary to comply with law, resolve disputes, enforce agreements, respond to your request, maintain business records, or establish, exercise, or defend legal claims.

Retention periods are operational targets, not guarantees of immediate deletion on a specific date. Actual retention may vary because of backups, legal holds, audits, disputes, investigations, technical constraints, vendor systems, tax or accounting obligations, payment records, affiliate payout records, or the need to preserve evidence of communications, consents, agreements, instructions, submissions, and service history.

International Transfers

Hemest is based in Canada, but some Service Providers may process or store information in Canada, the United States, or other countries. Privacy laws in those places may differ from the laws where you live.

Where required by applicable law, we use reasonable safeguards for cross-border processing, including contractual protections with Service Providers where available.

Your Rights and Choices

Depending on where you live, you may have rights to:

access personal information we hold about you;
request correction of inaccurate information;
request deletion of certain information;
withdraw consent where processing is based on consent;
object to or restrict certain processing;
request information about how your information has been used or shared; and

You can control cookies through the cookie-control tool and through your browser settings. Deleting or blocking necessary cookie-control cookies may cause the Website to ask for your cookie choice again. Rejecting, deleting, or blocking optional affiliate attribution cookies may affect referral tracking but should not prevent normal browsing.

If we send marketing communications, you may unsubscribe or ask us to stop sending them. We may still send non-marketing communications, such as responses to inquiries, project communications, transaction records, legal notices, or service-related messages.

Privacy rights are subject to limits and exceptions under applicable law. We may refuse, limit, delay, or charge a lawful fee for a request where permitted by law, including where a request is unverifiable, abusive, repetitive, disproportionate, technically infeasible, legally restricted, harmful to another person's rights, or inconsistent with legal, tax, accounting, security, dispute, fraud-prevention, contract, or record-keeping obligations.

Some browsers or tools may offer "Do Not Track", Global Privacy Control, or similar signals. There is no single uniform technical or legal standard that applies to every such signal. Hemest does not currently use advertising cookies, remarketing cookies, or cross-context behavioral advertising on the Website. If we add tools that require legally recognized opt-out signals to be honored, we will update our practices and notices as required by applicable law.

Automated Tools

Hemest may use automation, templates, scripts, filters, scoring, spam detection, fraud checks, duplicate-lead checks, AI-assisted tools, or similar technologies to operate the Website, route forms, evaluate inquiries, support sales workflows, draft communications, improve services, or document business processes. These tools may assist Hemest personnel, but Hemest does not currently use them to make legally significant decisions about individuals without human involvement.

Legal Disclosure

Hemest may disclose personal information if required to do so by law or in response to valid requests by public authorities, including courts, regulators, law enforcement, or government agencies.

Hemest may also disclose personal information in the good faith belief that such action is necessary to:

comply with a legal obligation;
protect and defend the rights, property, security, or legal interests of Hemest;
prevent or investigate possible wrongdoing in connection with the Website or services;
protect the personal safety of individuals or the public; or

Hemest may preserve and disclose information where reasonably necessary to investigate suspected fraud, spam, security incidents, unauthorized access, payment disputes, chargebacks, affiliate abuse, policy violations, unlawful activity, or threats to the Website, services, clients, affiliates, Hemest, or others.
